These Terms of Service ("Terms") are an agreement between you and Estima-CRM LLC, an Illinois limited liability company ("Estima," "we," "us"). They govern this website (estimacrm.com) and the Estima CRM service (app.estimacrm.com). By creating an account or using the service, you agree to them. If you're signing up on behalf of a company, you're agreeing for that company, and "you" below means the company.
1. What Estima is
Estima is business software for landscape, hardscape, and maintenance companies: estimating, projects, scheduling, invoicing, payment tracking, a client portal, QuickBooks Online sync, and optional add-ons such as Website Leads and AI Lead Replies. It's a tool for running your business — it's meant for business use, not personal or consumer use. We improve Estima continuously, so features will evolve over time.
2. Accounts and roles
- Keep your account information accurate and your sign-in credentials safe.
- Your company's admins control who on your team has access and at what permission level (admin, office, crew). You're responsible for activity that happens under your company's accounts.
- Tell us promptly at support@estimacrm.com if you suspect unauthorized access.
3. Subscriptions, trials, and billing
- Estima is a paid subscription. Current plans, add-ons, and prices are listed on our pricing page, and are billed monthly or annually depending on what you choose.
- If your signup includes a free trial, the trial length is stated when you sign up. When it ends, continued use requires an active subscription and payment method.
- Subscription payments are processed by Stripe. We don't see or store your card number.
- We can change prices with at least 30 days' notice; changes take effect at your next billing cycle. Prices don't include any applicable taxes.
- If a payment fails, we'll notify you and retry before suspending access.
4. Launch promotion
Where offered, the launch promotion gives new customers 50% off their plan price for the first 3 months. Add-ons are billed at full price and aren't part of the promotion. One promotion per customer; it can't be combined with other offers. We may change or end the promotion for future signups at any time — that never affects a discount you've already been given.
5. Cancellation and refunds
- There are no long-term contracts. You can cancel anytime from your account settings or by emailing support@estimacrm.com.
- When you cancel, you won't be charged again, and your access continues through the end of the period you've already paid for.
- Amounts already paid are non-refundable, except where the law requires otherwise.
- One-time fees (for example, the text-messaging carrier activation fee) are non-refundable once the underlying work or registration has started.
6. Your data
- You own your data. Your clients, estimates, invoices, photos, and everything else you put into Estima belong to your company.
- You give us permission to host, process, and transmit that data solely to provide and support the service, as described in our Privacy Policy.
- You're responsible for the data you store and the messages you send through Estima: that you have the right to store your clients' information, that your emails and texts comply with applicable law, and that you've collected any consents the law requires (for example, SMS opt-in).

7. AI features
Optional AI features, like AI Lead Replies, generate automated content. AI can be wrong: review the messaging style and sample output you configure, and spot-check what goes out. When you enable automatic replies, you're authorizing Estima to send AI-generated messages on your company's behalf, and your company remains responsible for them. AI output is not professional, legal, or financial advice.
8. Third-party services
Estima connects to services you choose to use — QuickBooks Online, QuickBooks Payments, Google Calendar, Stripe, and (when available) Twilio for text messaging. Those services have their own terms and privacy policies, which apply to your use of them. Integrations depend on the providers: if a provider changes or discontinues something, the connected feature may change or stop working, and we're not liable for the third-party service itself.
9. Acceptable use
Don't use Estima to break the law; don't send spam or messages without any consent the law requires; don't upload content that's infringing or malicious; don't probe, disrupt, or try to access other companies' data; and don't copy, resell, scrape, or reverse-engineer the service without our written permission.
10. Availability and changes
We work hard to keep Estima fast and available, but we don't guarantee uninterrupted service — maintenance, updates, and the occasional problem happen. We may add, change, or retire features; if we materially reduce something you pay for, we'll give you notice.
11. Disclaimers
Estima is provided "as is" and "as available," without warranties of any kind. Estima is a tool that helps you estimate, schedule, and bill — your prices, margins, taxes, and business decisions remain yours. Nothing in Estima is accounting, tax, or legal advice.
12. Limitation of liability
To the fullest extent the law allows: we're not liable for indirect, incidental, special, or consequential damages, or lost profits or revenue; and our total liability for all claims combined is capped at the amount you paid Estima in the 12 months before the event giving rise to the claim.
13. Indemnification
You'll defend and indemnify Estima against third-party claims arising from your data, the communications you send through the service, or your breach of these Terms.
14. Suspension and termination
We may suspend or terminate access for breach of these Terms, non-payment (after notice), or activity that puts the service or other customers at risk. You can close your account at any time. After an account closes, you have 30 days to request an export of your data, after which we may delete it as described in the Privacy Policy. Sections that by their nature should survive termination (like ownership, liability limits, and governing law) survive.
15. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Cook County, Illinois.
16. Changes to these Terms
We may update these Terms. If a change is material, we'll notify account holders by email or inside the app at least 15 days before it takes effect. Continuing to use Estima after a change takes effect means you accept it.
